Information On The Law No:6331 On Occupational Health and Security

The Article 6 of the Law on Occupational Health and Safety numbered 6331, published on 30.06.2012, with the heading “Occupational Health and Safety Services” sets forth that the employer is obliged to designate workers as occupational safety specialist, occupational physician and other health staff, for the workplaces having 10 (ten) or more than 10 (ten) employees and which are classified under very hazardous category, in order to provide occupational health and safety services including also the activities related to the protection and prevention of occupational risks.

This obligation which is set forth under this Law, also becomes effective as of 1 July 2016, in line with the Article 38 of the Law with the heading “”Effectiveness” for the workplaces having employees more than 10 (ten) and less than 50 (fifty) and which are classified under low hazardous category. That is to say, the workplaces having 10 (ten) and 49 (forty-nine) employees shall be obliged to designate occupational safety specialist and occupational physician as of 01.07.2016.

The employers or the representatives of the employers of the workplaces having less than 10 (ten) employees which are classified under low hazardous category may carry out themselves the services related to the occupational health and safety, except the employment and periodic inspections and controls. That is to say, provided that they participate to the educational trainings of Occupational Health and Safety Services E-Certificate Program which are regulated in accordance with the protocol for training, exam and certification executed by and between University of Anatolian and Ministry of Labor and Social Security on cooperation for the execution of occupational health and safety services by the employer and the representative of the employer, they may carry out themselves the services related to the occupational health and safety for the work places having less than 10 (ten) employees.

In case of non-compliance with related law and the regulations, severe administrative fines shall be applied for non-compliance.
